Islamabad High Court has directed Attorney General to submit his response on legal reservations against Telenor’s recent 4G spectrum auction. Zong, Mobilink and Warid have submitted a petition against Telenor’s new 4G spectrum in Islamabad High Court.
Zong’s legal team pointed out in the court that with the decision of Supreme Court Justice Saqib Nisar it has been proven that the spectrum auction for Telenor 4G was not according to rules and regulations. He added that the Supreme Court decision made it clear that no financial decision or project can be declared as federal project or without the approval of Federal Cabinet.
Telenor’s new spectrum was not given any approval from the Federal Cabinet and therefore it should be declared null and void.
In response to this, Ministry of Information and Technology replied that terming the auction of Telenor 4G spectrum illegal would create a crisis in the telecom sector. Considering this, it requested the court to overlook this legal problem.
Islamabad High Court replied that in light of Supreme Court’s decision, this would not be possible and directed Federal Attorney General of Pakistan to submit a detailed response on next session.
