Supreme Court: Important Cases, Including PTI Founder’s Petition, Scheduled for Hearing

The Constitutional Bench of the Supreme Court of Pakistan has released the cause list for the judicial week starting from January 6, 2025. The 7-member larger bench, led by Justice Aminuddin Khan, will include Justice Jamal Khan Mandokhel, Justice Mohammad Ali Mazhar, Justice Syed Hassan Azhar Rizvi, Justice Musarat Hilali, Justice Naeem Akhtar Afghan, and Justice Shahid Bilal Hassan. The bench will hear cases in Court No. 2 from January 6 to January 10. The bench is scheduled to hear 50 cases over the five days of the week.

On Tuesday, the following cases will be heard: 38 review petitions regarding the trial of civilians in military courts; a petition filed by Professor Mohammad Ibrahim Khan and others against the ERA (Earthquake Reconstruction and Rehabilitation Authority); a petition by former Senator Farhatullah Babar regarding the mass expulsion of Afghan refugees; a case concerning the licenses for submachine guns and other prohibited weapon bores; and a contempt petition against the Chairman of EOBI and the Secretary of the Ministry of Labour and Manpower.

The petition filed by PTI’s founder and chairman, Imran Khan, seeking the formation of a Judicial Commission to investigate the February 8, 2024, general elections, as well as a petition by Sher Afzal Khan Marwat challenging the appointment of the Chief Election Commissioner and requesting the results of the 2024 general elections to be compiled according to Form 45, will also be heard on Tuesday.

On Wednesday, the cases concerning petitions filed by Aitzaz Ahsan, Amina Masood Janjua, Khushdil Khan Malik, and others to prevent forced disappearances will be heard. A public interest petition filed by the Public Interest Law Association regarding the establishment of an Environmental Change Authority will also be heard. A petition for the establishment of a one-man commission to investigate the Jaranwala incident will be heard as well.

On Thursday, the court will hear cases related to the enforcement of a suo-motu notice regarding tree cutting in F-9 Park, Islamabad, against CDA (Capital Development Authority), and a petition filed by Iqbal Dar and others against the excessive rise in electricity prices. Additionally, petitions filed by Imran Khan, Sheikh Rashid Ahmed, and others challenging amendments to the Elections Act 2017 in 2022 will be heard, along with a petition filed by former Punjab Chief Minister Hamza Shahbaz against the Deputy Speaker’s ruling on July 22, 2022, regarding former Punjab Chief Minister Chaudhry Pervez Elahi.

On Friday, the Supreme Court will hear petitions related to child trafficking and abduction, filed by Zia Ahmed Awan and others. Raja Manzoor Ahmed’s petition against the discretionary fund allocations to Chief Executives will also be heard. Petitions filed by former Gilgit-Baltistan Chief Minister Khalid Khurshid Khan challenging the Prime Minister’s appointments of judges in Gilgit-Baltistan without the advice of the Chief Minister and Cabinet will be considered. Additionally, petitions filed by Hamza Mohammad Khawaja, Mohammad Usman Amir, and others against the ban on student unions will be heard.

Finally, on Friday, a suo-motu notice regarding the practice of selling water extracted from land by mineral water companies will be discussed, along with a petition filed by Malik Mushtaq Hussain Awan seeking clarification of Article 62(1)(d) of the Constitution of Pakistan, in which the Speaker of the National Assembly and others have been made parties to the petition.
