Supreme Court to hear petitions against the 26th Constitutional Amendment today

The Supreme Court of Pakistan will hear petitions against the 26th Constitutional Amendment in a session led by Senior Judge Justice Amin-ud-Din Khan.

A seven-member constitutional bench will hear 39 petitions on Tuesday regarding the trial of civilians in military courts.

The supplementary cause list for this decision was issued on Sunday.

The senior-most judges of the Supreme Court, Justice Syed Mansoor Ali Shah and Justice Aqeel Ahmed Abbasi, will announce the reserved verdict on the contempt of court case against former Additional Registrar (Judicial) Nazir Abbas, who was removed from his position, in the Supreme Court bench powers case. The decision will be announced at 9:30 AM today (Monday). A supplementary cause list for the decision was issued on Sunday. Notices have been issued to Attorney General Mansoor Usman Awan, judicial assistants Muneer Ahmad Malik, Hamid Khan, Khawaja Haris Ahmad, and Chaudhry Muhammad Ahsen Bhon in connection with the decision. Notices have also been issued to the lawyer representing the petitioners in the main case, Barrister Syed Salahuddin Ahmed.

Justice Syed Mansoor Ali Shah and Justice Aqeel Ahmed Abbasi had reserved the verdict after hearing all arguments from the judicial assistants and lawyers on Thursday. Meanwhile, in a separate case, a six-member larger bench, led by Justice Jamal Khan Mandokhel and comprising Justice Muhammad Ali Mazhar, Justice Athar Minallah, Justice Syed Hassan Azhar Rizvi, Justice Shahid Waheed, and Justice Musarat Hilali, will hear the appeal and stay order requests filed against the interim order issued in the contempt of court notice related to Nazir Abbas, today (Monday) at 1 PM in Courtroom No. 3. The federation of Pakistan is a party in the petition, and the petitioner will be represented by lawyer Shahid Kamal Khan.

Supreme Court to hear 29 petitions against the 26th Constitutional Amendment

The eight-member constitutional bench of the Supreme Court of Pakistan will hear 29 petitions filed against the 26th Constitutional Amendment today (Monday). The bench, led by Senior Judge Justice Amin-ud-Din Khan and comprising Justices Jamal Khan Mandokhel, Muhammad Ali Mazhar, Ayesha A. Malik, Syed Hassan Azhar Rizvi, Musarat Hilali, Naeem Akhtar Afghan, and Shahid Bilal Hassan, will hear the petitions in Courtroom No. 3. Special arrangements have been made in the Supreme Court for the hearing. Journalists, lawyers, and petitioners have been issued special passes for the hearing. Strict security measures have been put in place for the hearing. The Press Association of Pakistan has been allotted a special gallery in Courtroom No. 3. Journalists without special passes will be allowed to attend in Courtrooms No. 6 and 7, where they will be provided with audio facilities.

The petitions were filed by Muhammad Anas, Muhammad Shahid Rana, Afrasiab Khan Khatak, Mian Atif Mehmood, former President of the Supreme Court Bar Association Abid Shahid Zuberi, the Balochistan Bar Council, the Presidents of the Balochistan and Lahore High Court Bar Associations, Muhammad Ali Kanrani, Amir Jamaat-e-Islami Pakistan Engineer Hafiz Naeem-ur-Rehman, Muhammad Azhar Siddique Advocate, Barrister Syed Salahuddin Ahmed, BNP (Mengal) Chairman and Member of the National Assembly Sardar Muhammad Akhtar Jan Mengal, Bakhtiar Mahmood Kasuri, Syed Salman Haider Jaffery, Zainab Janjua, Maria Ahmad, Abid Hassan Manto, Sunni Ittehad Council, President Karachi Bar Association, Ibrahim Saifuddin Advocate, Tofiq Asif Advocate, Secretary Supreme Court Bar Association Salman Mansoor, President Islamabad High Court Bar Association Sheikh Ahsan-ud-Din, Faheem Zaman Khan, Kashif Hanif, President Lahore Bar Association Mansher Rehman Chaudhary, Wasim Abbas, and others.

The petitioners will be represented by Senator Hamid Khan Advocate, former Attorney General Muneer Ahmad Malik, Member of the National Assembly Sardar Muhammad Latif Khan Khosa, Faisal Siddiqui, Tofiq Asif, Salman Mansoor, Barrister Salahuddin Ahmed, Khawaja Ahmed Hussain, Abid Shahid Zuberi, Azir Kramat Bhandari, Imran Shafiq Advocate, Mashaak Ahmad Mohil, Sheikh Ahsan-ud-Din, Adnan Khan, Muhammad Waqaar Rana, Muhammad Ali, Muhammad Azhar Siddique, Syed Salman Haider Jaffery, Samiuddin, Rawi Pindani, Shahbaz Ali Khan Khosa, Tipu Salman Makhdoom, Shahid Saleem, Zia-ullah, and others.

The Federation of Pakistan, the President of Pakistan, the Ministry of Law and Justice, the Secretary of the President’s House, and the Secretary of the Ministry of Law and Justice, among others, have been named as parties to the petitions. The bench has not yet issued notices to the Attorney General’s office. After hearing the arguments of the petitioners’ lawyers, the bench will decide whether or not to issue notices to the Federation of Pakistan.

Among the 29 petitions against the 26th Constitutional Amendment, 22 are included in the final cause list, and 7 are included in the supplementary cause list for hearing.

Meanwhile, the seven-member larger bench, led by Justice Amin-ud-Din Khan and comprising Justices Jamal Khan Mandokhel, Muhammad Ali Mazhar, Syed Hassan Azhar Rizvi, Musarat Hilali, Naeem Akhtar Afghan, and Shahid Bilal Hassan, will hear 39 petitions regarding the trial of civilians in military courts on January 28 (Tuesday). The Ministry of Defence’s lawyer Khawaja Haris Ahmed will continue his arguments. After Khawaja Haris completes his arguments, the lawyers for the respondents, including Hamid Khan Advocate, Khawaja Ahmed Hussain, Sardar Muhammad Latif Khan Khosa, Faisal Siddiqui Advocate, Barrister Salman Akram Raja, and others, will present their arguments.
